MASTER TERMS & CONDITIONS OF USE

1. LEGAL AGREEMENT / ACCEPTANCE

1.1 The use of the Platform and all related services (the “Service”) is subject to these Terms & Conditions (“Terms”).

1.2 The terms “Travgoworld”, “We”, “Us”, and “Our” refer to Travgoworld.com platform, including without limitation Liberty Travel Albania sh.p.k., as the Operator.

1.3 These Terms form a legal agreement. By accessing or using the Service, You agree to be bound by these Terms as amended from time to time.

1.4 TRAVGoWorld reserves the right, at its sole discretion, to change, modify, or replace these Terms at any time, with or without notice. You are responsible for reviewing these Terms regularly. Continued use constitutes acceptance of the revised Terms.


2. DEFINITIONS

  • “Agency” / “Partner” / “You” — Approved travel agency or corporate entity using the Platform

  • “Client” / “Guest” — End customer of the Agency

  • “Supplier” — Hotels, airlines, DMCs, consolidators, or other service providers

  • “Booking” — Any confirmed reservation or issued ticket made via the Platform

  • “ADM” — Agency Debit Memo issued by an airline

  • “BSP” — Billing and Settlement Plan administered by IATA

  • “Onward Sale” — Any resale by the Agency to its Client (B2C or B2B within the Agency’s network)


3. SERVICE DESCRIPTION / PLATFORM ROLE

3.1 The Platform provides Agencies access to inventory made available by Suppliers (including hotels and air tickets). Liberty Travel, through Travgoworld, assists business needs for travel-related services and acts as a mediator/intermediary between Agencies and Suppliers.

3.2 Travgoworld does not own, operate, manage, or control Supplier services.

3.3 Any part of the Service may be changed, discontinued, suspended, or modified at any time.

3.4 When the Service is terminated or expires, access to the Platform and Site ends.


4. B2B WHOLESALE NATURE / ELIGIBILITY

4.1 The Platform is strictly B2B and not intended for consumer use.

4.2 Access is restricted to licensed travel professionals and approved corporate entities.

4.3 Travgoworld.com  may request documentation at any time, including:

  • - Business registration

  • - Tax certificate

  • - IATA accreditation (if applicable)

  • - Financial references

  • - KYC/compliance documentation

4.4 Approval, refusal, suspension, limitation of functions, or termination is at liberty travel’s sole discretion.

4.5 The Agency acts as merchant toward its clients and assumes full responsibility for compliance with applicable consumer laws in its jurisdiction.


5. ACCOUNT, CREDENTIALS, AND SECURITY

5.1 Upon registration, the Agency receives a user ID and password (login credentials). The Agency is strongly advised to change/renew passwords periodically.

5.2 The Agency is responsible for safeguarding credentials and preventing unauthorized use.

5.3 Travgoworld.com and Liberty Travel shall not be liable for unauthorized use or misuse of login credentials.

5.4 The Agency is responsible for keeping account details accurate and up-to-date (including contact data and payment card details) and may update them through account settings.

5.5 The Agency remains liable for all activity performed through its account even if used without its knowledge or consent.


6. SUB-AGENTS / THIRD-PARTY LIABILITY

6.1 The Agency may use the Platform for its internal network.

6.2 The Agency is fully responsible for actions/omissions of:

  • - Employees

  • - Sub-agents

  • - Branches

  • - Affiliates

  • - Contractors

6.3 Any misuse by a sub-agent or third party is deemed misuse by the Agency.


7. BOOKINGS, CONFIRMATIONS, AND AGENCY RESPONSIBILITY

7.1 A booking becomes binding upon issuance of confirmation (or ticket issuance for air).

7.2 The Agency must verify all booking details before confirmation, including names (passport spelling), dates, room types, board basis, flight segments, and fare conditions.

7.3 TRAVGoWorld is not responsible for Agency input errors.

7.4 Special requests are not guaranteed unless explicitly confirmed by the Supplier.


8. RATES, CONFIDENTIALITY, AND B2C RESTRICTIONS

8.1 Unless otherwise stated, rates are net and non-commissionable.

8.2 Rates typically include applicable taxes and service charge, except for city taxes, resort fees, and other additional local charges payable directly by guests at the hotel (when applicable under Supplier rules).

8.3 The Agency shall not at any time show, reveal, communicate, publish, promote, distribute, or share Travgoworld rates or inventory to any B2C channel, directly or indirectly.

8.4 The Agency must not:

  • - Publish net rates online

  • - Sell to other wholesalers without written authorization

  • - Redistribute inventory outside its permitted client base

  • - Engage in rate dumping

8.5 Breach of this Section constitutes material breach and may result in immediate suspension/termination and legal action.


9. CURRENCY, INVOICING, AND CONVERSION

9.1 Agencies shall settle invoices in EURO

9.2 If the Agency requests payment in a different currency, Travgoworld may accept or refuse at its sole discretion and apply a conversion rate determined by Liberty Travel SHPK..


10. PRICING ERRORS / MISLOADS / TECHNICAL FAULTS

10.1 Travgoworld.com reserves the right to correct or cancel bookings affected by manifest errors, including:

  • - Pricing errors

  • - Currency mistakes

  • - Supplier misloads

  • - Technical faults/system issues

10.2 In such cases, Travgoworld’s liability shall not exceed refund of the amount received for the affected booking (if paid).


11. PAYMENT METHODS, CARD TYPES, AND FEES

11.1 Accepted payment methods may include:

  • - Available credit facility (if granted)

  • - Online payment by card

  • - Bank transfer / prepayment

11.2 Unless otherwise specified by Travgoword, card payments may be accepted via Visa and MasterCard credit/debit cards in EUR.

11.3 The Agency bears bank charges, gateway fees, and transaction costs unless expressly agreed otherwise.

11.4 Credit facilities, if granted, may be reduced, suspended, or revoked at any time.

11.5 Overdue balances may result in immediate suspension, cancellation of bookings, and legal recovery.


12. NO-SHOW

12.1 A “No Show” occurs when a guest fails to arrive at the accommodation without prior notification and within the applicable Supplier conditions.

12.2 In the event of a no-show, no refunds apply unless the Supplier policy explicitly provides otherwise.


13. TURN-AWAY / DENIED CHECK-IN / OVERBOOKING / ROOMS OUT OF SERVICE

13.1 In the event of a “turn away” (denied check-in due to overbooking, rooms out of service, or other Supplier-side reasons), the Supplier shall, where applicable under Supplier policy, arrange alternative accommodation of comparable standard in a similar location at no additional cost to the guest, or otherwise provide a full refund.

13.2 Travgoworld acts as facilitator only and does not assume Supplier obligations.

13.3 Compensation cap: unless mandatory law or Supplier policy provides otherwise, any compensation offered (if any) shall not exceed 30% of the value of the original booking.


14. CANCELLATIONS, AMENDMENTS, AND POLICY ENFORCEMENT

14.1 Each booking is governed by the cancellation/amendment/no-show terms displayed at booking and/or Supplier rules.

14.2 Amendments are subject to availability and may incur fees or price differences.

14.3 TRAVGoWorld cannot override Supplier policies unless expressly authorized by the Supplier.


15. GROUP BOOKINGS (FIT LIMITATION)

15.1 The Platform and rates are designed for FIT bookings.

15.2 Any reservation of 6 rooms or more (whether in a single booking or split/combined bookings with the same check-in/check-out dates) may be treated by the hotel as a group booking.

15.3 If a booking is deemed a group booking in breach of policy, the hotel/Supplier may cancel it and/or apply group terms.

15.4 The Agency should contact TRAVGoWorld for group booking requests before booking.


16. NO LIABILITY FOR ONWARD SALES / SUPPLIER CONTENT

16.1 Travgoworld’s contract for the sale of travel components is with the Agency. When a guest contracts for travel services, they do so with the Agency, not Travgoworld.

16.2 The Agency is fully responsible for the Onward Sale, including pricing, representations, and handling client disputes.

16.3 Property classification, descriptions, photos, amenities, facilities, reviews, and other content are provided by Suppliers. Travgoworld is not responsible for errors, omissions, or inaccurate Supplier-provided content.

16.4 Travgoworld is not responsible for disputes between the Agency and its clients arising from the Agency’s Onward Sale.

16.5 If a claim is made against Travgoworlld due to the Agency’s Onward Sale, the Agency agrees to indemnify Travgoworld for all damages, fees, charges, and costs incurred.

16.6 It is explicitly understood that Travgoworld acts only as an intermediary in making arrangements and is not liable for personal injury, illness, property damage, or other loss arising directly or indirectly from Supplier actions.


17. PASSPORT, VISA, IMMIGRATION, AND ENTRY REQUIREMENTS

17.1 The Agency is responsible for confirming passport, visa, and immigration requirements with relevant authorities.

17.2 Travgoworld assumes no responsibility if a client is unable to travel due to non-compliance with such requirements.


?? 18. AIR TICKETS — AIRLINE RULES, IATA / BSP, AND ADM LIABILITY

18.1 All air bookings are subject to:

  • - Airline fare rules

  • - Conditions of carriage

  • - IATA regulations

  • - BSP procedures

  • - Carrier and fare-specific restrictions

18.2 The Agency must strictly follow airline booking, ticketing, exchange, refund, void, name rules, and any fare or negotiated-rate conditions.


18.3 PROHIBITED / ABUSIVE TICKETING PRACTICES

The following are strictly forbidden and considered abuse:

  • - Fictitious or speculative bookings

  • - Duplicate bookings

  • - Throwaway ticketing

  • - Hidden-city ticketing

  • - Back-to-back ticketing

  • - Name manipulation

  • - Abuse of refund/exchange/void rules

  • - Unauthorized voids or exchanges

  • I- nvalid fare combinations

  • - ircumvention of airline restrictions

Travgoworld may suspend ticketing or terminate accounts immediately if abuse is suspected or detected.


18.4 ADM (AGENCY DEBIT MEMO) — FULL AGENCY LIABILITY

18.4.1 Any ADM issued by an airline relating to bookings/tickets created through the Platform shall be fully borne by the Agency.

18.4.2 This includes (non-exhaustive):

  • - Fare violations

  • - Ticketing abuse

  • - Improper refunds/exchanges/voids

  • - Name errors

  • - Misuse of negotiated fares

  • - Commission violations

  • - No-show penalties

  • - Credit card misuse

  • - Policy breaches

18.4.3 Travgoworld reserves the right to recover ADM amounts by:

  • - Immediate debit to the Agency

  • - Offset against available credit

  • - Suspension/removal of ticketing rights

  • - Legal recovery


18.5 BSP SETTLEMENT

18.5.1 BSP transactions follow IATA billing cycles.

18.5.2 The Agency must maintain sufficient financial capacity to cover liabilities.

18.5.3 Failure to meet BSP obligations may result in suspension, reporting to airlines, and legal recovery.

18.6 SCHEDULE CHANGES / IRROPS

TRAVGoWorld is not responsible for airline delays, cancellations, missed connections, aircraft changes, or other operational disruptions; these are governed by airline conditions and applicable rules.


19. CREDIT CARD USE, CHARGEBACKS, AND FRAUD

19.1 The Agency may use its company card or a guest card for bookings.

19.2 A guest credit card must only be used to pay for bookings of the same guest.

19.3 The Agency is solely responsible for ensuring that genuine cards are used.

19.4 The Agency assumes full liability for losses arising from stolen/fake cards or chargebacks.

19.5 Unauthorized chargebacks (without first attempting resolution with Travgworld) are prohibited and may result in immediate termination and recovery action.


20. SUPPORT AND SECURITY RECOMMENDATIONS

20.1 TRAVGoWorld provides support for Platform usage during the cooperation period, subject to support channels and hours communicated by Travgoworld.

20.2 TRAVGoWorld strongly recommends that the Agency uses a bank/provider supporting 3D Secure to mitigate fraud risk.

20.3 In case of fraudulent bookings, the Agency should contact its bank/provider; TRAVGoWorld is not responsible for bank-side fraud controls.


21. REFUNDS

21.1 Refunds (if applicable under Supplier policy) shall be made to the original instrument used at the time of booking.

21.2 If TRAVGoWorld is unable to process an immediate refund due to Supplier constraints or operational reasons, the amount may be held as future available credit for the Agency, unless prohibited by law or the original payment instrument rules.

21.3 Refunds are processed only through the original mode of payment unless Travgoworld agrees otherwise in writing.


22. DATA PRIVACY / GDPR

22.1 The Agency confirms it has obtained all required consents from data subjects for transfer of personal data to TRAVGoWorld and for onward transfers necessary to perform travel services.

22.2 Personal data is processed in accordance with applicable data protection laws, including GDPR (EU) 2016/679 where applicable.

22.3 The Parties agree to maintain confidentiality/professional secrecy of personal data even after termination and ensure personnel comply.

22.4 The Agency shall be liable for claims, sanctions, losses, or damages arising from the Agency’s breach of data protection obligations, including breaches by its employees or contracted third parties, and shall indemnify TRAVGoWorld accordingly.


23. PRIVACY POLICY

TRAVGoWorld’s Privacy Policy forms part of these Terms and may be updated from time to time. It is published on TRAVGoWorld under the “Privacy Policy” page (https://b2b.travgoworld.com/privacypolicy ).


24. PROHIBITED USE / SPAMMING / ABUSE

The Agency must not use the Platform for:

  • - Illegal activity

  • - Spamming or abusive conduct

  • - Manipulating availability or prices

  • - Excessive speculative “expensive” holds/bookings that indicate abuse risk

  • - Conduct harmful to Travgoworld, Suppliers, or other parties


25. SUSPENSION AND TERMINATION

25.1 Travgoworld may terminate or suspend the Service (in whole or in part) immediately, with or without notice, including if:

  • - The Agency violates any Terms

  • - TRAVGoWorld discovers services are used without proper regulation

  • - Excessive/high-risk use indicates abuse or credit risk

  • - Any spamming occurs

  • - The Agency’s use interferes with Travgoworld business or impacts others negatively

25.2 The Agency may request termination by contacting Travgoworld customer service in writing.

25.3 Termination does not relieve the Agency of payment obligations, including outstanding invoices, penalties, or ADMs.


26. INDEMNIFICATION

The Agency agrees to indemnify and hold harmless Travgoworld /Liberty Travel from and against all claims, damages, liabilities, penalties, costs, and expenses arising from:

  • - Agency breach of these Terms

  • - Sub-agent actions

  • - Client disputes arising from Onward Sale

  • - Fraud/chargebacks

  • - Regulatory sanctions attributable to the Agency

  • - Airline ADMs attributable to the Agency’s ticketing behavior


27. LIMITATION OF LIABILITY

27.1 Travgoworld shall not be liable for indirect, consequential, special, or punitive damages, including loss of profit or business.

27.2 Travgoworld maximum aggregate liability (if any) shall not exceed the service fee earned by Travgoworld for the affected booking.


28. FORCE MAJEURE

Travgoworld shall not be liable for failure or delay due to events beyond reasonable control, including natural disasters, war, pandemics, government actions, strikes, supplier failures, or system outages.


29. SYSTEM AVAILABILITY

Travgoworld does not guarantee uninterrupted access. Maintenance, outages, latency, and technical failures may occur.


30. COMPLIANCE / AML / ANTI-BRIBERY / SANCTIONS

The Agency must comply with all applicable laws and regulations, including:

  • - Anti-money laundering

  • - Anti-corruption/anti-bribery

  • - Sanctions and export controls

  • - Any local regulatory requirements applicable to travel distribution


31. INSOLVENCY / FINANCIAL RISK

Travgoworld may suspend or restrict services if the Agency is deemed financially unstable, exceeds credit risk thresholds, or is at risk of default.


32. DISPUTES / GOVERNING LAW / JURISDICTION / LANGUAGE

32.1 All disputes shall first be attempted to be settled in good faith by negotiations between the Parties.

32.2 If settlement fails, disputes shall be subject to the courts of Tirana, Republic of Albania.

32.3 The language of proceedings/arbitration (if applicable) shall be Albanian.

32.4 Liberty Travel SHPK reserves the right to initiate proceedings in the competent court located in the country where the Agency is based or of the Agency’s nationality, where lawful and strategically required for recovery/enforcement.

32.5 These Terms are governed by the laws of the Republic of Albania.


33. ENTIRE AGREEMENT

These Terms, together with any additional conditions displayed on the Platform, form the entire agreement between Travgoworld /Liberty Travel and the Agency regarding use of the Service.
